No go with ballooning refund claim
Jul 21st 2013, 06:00, by Anna Tims

After Go Ballooning went into administration I was rejected by Co-op for a credit card refund

I spent £178 on two flights from Go Ballooning but the company went into administration. I wrote to Co-op Visa in April to request a refund. It rejected my claim because of rules laid down by Visa International which state claims must be made within 540 days of a transaction.

I see in your response to another Go Ballooning customer that credit card transactions are protected . This appears to contradict the Co-op. AM, Exeter

It seems the bank thought you'd used a debit card, in which case you would have been stymied by the 540-day limit. Section 75 of the Consumer Credit Act does, indeed, allow you to claim a refund without deadline, but there's another problem. It applies only to single transactions over £100 and since you bought the vouchers separately and each cost less, you are not covered.

The Co-op initially said you would be refunded then changed it's mind when it reread the Consumer Credit Act. However, it has now done the decent thing and refunded you anyway, as an apology for twice misleading you.If you need help email Anna Tims at your.problems@observer.co.uk or write to Your Problems, The Observer, Kings Place, 90 York Way, London N1 9GU.
